The Impact and Implications of California's AB 542 Law on Self-storage Advertising

California Governor Gavin Newsom has officially signed Assembly Bill 542 (AB 542) into effect, transforming the advertising landscape for self-storage operators within the state and authored by Assembly Member Juan Carrillo and his team, in collaboration with Naomi Padron, a legislative advocated partner for MKP Government Relations and the Self Storage Association’s Sacramento-based lobbyist, the law ushers in significant advertising flexibility for businesses starting January 1.
The passage of AB 542 sees a decrease in obligatory newspaper ads from two to one if the company also markets the lien sale online. This shift increases the visibility and accessibility of such sales, tapping into the broader reach of the internet. Additionally, operators can now advertise in a generally circulating newspaper within the public-notice district or county where their storage facility resides. The revamped law launched a new era where the emphasis on item description in auction advertising is abolished, simplifying ad content.
Previously, the California legislature debated the prospects of Black Carlon's AB 542 bill, which seeks to provide self-storage businesses with alternative options for advertising a lien sale. Without a widespread newspaper within the district or county of the lien sale, businesses were obligated to post an advertisement at least ten days before the auction in a minimum of six noticeable locations in the auction neighborhood.
The bill garnered staunch support from the National Self-Storage Association (SSA) and its California counterpart, the California Self-Storage Association (CSSA). The CSSA had vouched for the bill during the prior May 1 general assembly vote, which unanimously approved the bill in a 78-0 vote. Currently, the bill is set for senate review based on a May 8 communique to SSA members after an introduction in February.
